Citizenship may be applied for after 5 years of continuous legal residence on a permanent residence permit, subject to Azerbaijani language proficiency, legal income source, and renunciation of other citizenship (Azerbaijan does not recognise dual citizenship).

Azerbaijan's Investor Temporary Residence Permit allows foreign nationals and stateless persons to reside in Azerbaijan based on qualifying capital investments in the country's economy. The program is established under the Migration Code of the Republic of Azerbaijan (Law No. 713-IVQ of 2 July 2013, Articles 45–48), as amended in April 2023 and December 2024. It is administered by the State Migration Service (Dövlət Miqrasiya Xidməti), with applications processed through ASAN Service centres, the State Migration Service electronic portal, and the e-Government Information System. The program offers four qualifying investment categories at different thresholds, with no educational or professional qualifications required.

Investment Options

Applicants must meet one of the following investment criteria:

  • Economy investment: at least AZN 500,000 (~USD 295,000) in Azerbaijan's economy — grants a permit for up to 3 years
  • Real estate: ownership of property worth at least AZN 100,000 (~USD 59,000)
  • Bank deposit: a fixed-term deposit of at least AZN 100,000 with an Azerbaijani bank (current accounts do not qualify)
  • State securities: ownership of qualifying state or state-majority-owned entity securities with a nominal value of at least AZN 100,000 (added as a category by the April 2023 amendments)

For real estate, bank deposit, and securities categories, the permit is initially issued for up to 1 year and can be extended for up to 2 years per extension, provided the investment basis is maintained.

Duration & Renewal

The AZN 500,000 economy investment category grants a permit for up to 3 years. The real estate, bank deposit, and securities categories grant permits for up to 1 year, extendable for up to 2 years per extension. Extension applications must be submitted at least 30 days before expiry. Holders who acquire securities as the basis for their residence must notify the State Migration Service if the value falls below the qualifying threshold or if expropriation occurs.

Family Members

Spouse, children, and parents aged 65 or older may apply for temporary residence permits as family members under Article 45.1.5 of the Migration Code. Each family member must submit a separate application with a consent letter from the primary permit holder. Family member permits are tied to the primary holder's permit duration. Dependants who wish to work must obtain separate work permits.

Tax Implications

Tax residency is determined by physical presence: individuals present in Azerbaijan for more than 182 days in a calendar year are taxed on worldwide income. The seven-year 0% exemption on non-oil/non-gas private-sector salaries expired on 1 January 2026. Under the Tax Code amendments adopted in November 2025 and effective from 2026, monthly salary income of non-oil/non-gas private-sector employees is taxed at 3% on income up to AZN 2,500 (rising to 5% in 2027 and 7% from 2028), AZN 75 + 10% on the AZN 2,500–8,000 band, and AZN 625 + 14% on income over AZN 8,000. Standard rates for oil/gas and government-sector employees remain 14% up to AZN 2,500 and AZN 350 + 25% on the excess. Dividends are taxed at 5%, interest at 10%, and rental income at 14%. Non-residents are taxed only on Azerbaijan-source income.

Application Process

Applicants must first enter Azerbaijan on a valid visa (business or personal visit). The temporary residence permit application is submitted through ASAN Service centres, the State Migration Service electronic portal (eservice.migration.gov.az), the MIGAZ mobile application, or the e-Government Portal service 3304 (e-gov.az). Since 28 January 2025, TRP/PRP and work permit submissions are integrated into the Electronic Government Information System.

State fees vary by duration and processing speed. Standard processing (20 working days): AZN 30 (up to 3 months), AZN 60 (6 months), AZN 120 (1 year), AZN 360 (3 years). Expedited processing (15 working days): AZN 40, AZN 80, AZN 160, AZN 480 respectively. Minors receive reduced rates. Upon approval, a residence permit card (icazə vəsiqəsi) is issued. Application status can be tracked online; payment of the fee does not guarantee approval.

Path to Permanent Residence and Citizenship

After 2 consecutive years of temporary residence on the same investor grounds, the holder may apply for a permanent residence permit under Article 52 of the Migration Code. Permanent residence thresholds are higher: AZN 500,000 for economy investment; AZN 200,000 for real estate, bank deposits, or state securities. Permanent residence permits are valid for 5 years and renewable.

Citizenship may be applied for after 5 years of continuous legal residence on a permanent residence permit, subject to Azerbaijani language proficiency, legal income source, and renunciation of other citizenship — Azerbaijan does not recognise dual citizenship.

Important Considerations
  • The investment residence permit itself does not grant the right to work — a separate work permit is generally required for employment, although investors heading or managing entities with qualifying foreign investment may be exempt
  • The 2023 amendments tightened work permit exemptions: founders/shareholders must hold at least 51% of shares and maintain active managerial roles with capital/turnover thresholds
  • Bank deposits must be fixed-term (savings) deposits; current accounts do not qualify
  • Securities must maintain the minimum nominal value throughout the residence period
  • Temporary residence holders leaving Azerbaijan for more than 90 consecutive days within a 180-day period may face permit revocation; the AZN 500,000 economy investment category is exempt from this restriction under highly qualified migrant provisions
  • Tax residents (present 182+ days) must file annual tax returns with the State Tax Service
